The Polish Constitution of May 3rd designated as element of European Heritage

For Poles, the Constitution of May 3rd is one of the most important documents in the history of the Polish state. It was promulgated on May 3rd 1791 and was effective for only 14 months, however the anniversary of its entering into force has become a national holiday. Today – within the framework of the European Year of Cultural Heritage, of which the Polish edition is coordinated by the International Cultural Center in Krakow – the constitution, along with four other items, was honored as an Element of European Heritage. This distinction is awarded to entities which have a “strong symbolic European value and emphasize common European history and European Union development, as well as European values and human rights, as being the foundation of the process of European integration”.

The Polish Constitution of 1791 was inspired by the awareness that the existence of the independent and sovereign Polish state was threatened. A group of reformers realized that the state would not be able to confront the threat posed by powerful neighbors (Russia, Prussia, and Austria) if the state and its governmental system were not modernized. The May 3rd constitution, which was only the second document of its kind worldwide, preceded only by the Constitution of the United States, was supposed to become the basis for change.

The constitution introduced the change of the governmental system which meant that Poland ceased to be an elective monarchy. A mechanism for electing the king by the majority of the gentry had been introduced in the 16th century, but it turned out to be dangerously flawed as time went by. The country became the stage for power struggles among the neighboring countries who were trying to gain geopolitical influence within Poland. As of May 3rd 1791, Poland was to become a hereditary monarchy. The constitution introduced Montesquieu’s separation of powers system. It confirmed new laws enacted somewhat earlier, granting members of the bourgeoisie rights of personal safety, ownership of country estates, and rights to hold positions as military and public administration officers. It gave cities the right to send representatives to the parliament when municipal issues were on the debate agenda. It offered governmental protection to the peasants, who constituted the largest social group. It was not much, considering that it didn’t give them personal freedom, however up until then, they were completely at the mercy of the good or ill will of their landlords. The constitution introduced a standing army (100,000 soldiers) instead of general mobilization. It also abolished the liberum veto principle i.e. the right of every individual member of the gentry to dissolve the parliamentary session, which made it impossible to reach any decisions, and was an instrument used to destabilize the state.

In 1792, the constitution was abolished by the group of magnates who supported Russian influence within Poland, because it threatened their dominant position in the country. Yet again, the state was overtaken by chaos, and in 1795 it disappeared from the political map of Europe for 123 years. However, the memory of the May 3rd Constitution endured. For the Polish people this document proved that they were capable of transforming their country. Its progressive nature was referenced many times during the fight for independence which, with the exception of the interwar period, lasted effectively until 1989.

Dla Polaków Konstytucja 3 Maja to jeden z najważniejszych dokumentów w historii ich państwowości. Uchwalona 3 maja 1791 roku obowiązywała tylko 14 miesięcy, ale rocznica jej uchwalenia jest świętem narodowym. Teraz – w ramach Europejskiego Roku Dziedzictwa Kulturowego, którego polska edycja jest koordynowana przez Międzynarodowe Centrum Kultury w Krakowie – Konstytucja 3 Maja znalazła się wśród czterech polskich obiektów uhonorowanych Znakiem Dziedzictwa Europejskiego. To wyróżnienie jest przyznawane obiektom, które mają „silną europejską wartość symboliczną i podkreślają wspólną historię Europy i budowania Unii Europejskiej oraz europejskie wartości i prawa człowieka będące fundamentem procesu integracji europejskiej”.

Polska konstytucja z 1791 roku powstała ze świadomości, że istnienie niepodległego i suwerennego państwa polskiego jest zagrożone. Grupa reformatorów zdawała sobie sprawę, że kraj nie będzie mógł się przeciwstawić zagrożeniu ze strony potężnych sąsiadów (Rosja, Prusy, Austria) jeśli państwo i jego ustrój nie zostaną unowocześnione. Podstawą zmian miał być konstytucja. Ta uchwalona 3 Maja 1791 roku w Warszawie, była drugim takim spisanym aktem w świecie (po USA).

Wprowadziła zmianę ustroju Polski, która przestawała być monarchią elekcyjną. Zapoczątkowany w końcu XVI wieku mechanizm wyboru króla przez ogół szlachty, okazał się z czasem dla państwa zgubny. Kraj stał się areną walki państw sąsiednich o wpływy w Polsce. Od 3 maja 1791 roku Polska miała stać się monarchią dziedziczną. Konstytucja wprowadzała monteskiuszowski podział władz. Potwierdzała przyznane nieco wcześniej nowe prawa dla mieszczaństwa z prawem do bezpieczeństwa osobistego, posiadania majtków ziemskich i sprawowania funkcji oficerskich w wojsku i w administracji państwowej. Dawała miastom prawa do wysyłania do parlamentu swych przedstawicieli, gdy omawiane były sprawy miast dotyczące. Najliczniejszą grupę społeczną – chłopów pańszczyźnianych brała w opiekę państwa. To niewiele, bo wolności osobistej nie uzyskiwali, ale dotąd byli zdani na łaskę i niełaskę swych panów. Wprowadzała stałą armię (100 tysięcy żołnierzy). Znosiła liberum veto, czyli prawo każdego pojedynczego szlachcica do zerwania obrad parlamentu, co uniemożliwiało podejmowanie decyzji i było narzędziem do destabilizowania państwa.

W 1792 roku konstytucja została obalona przez znajdujących się pod wpływem Rosji magnatów, którym ten akt prawny odbierał dominującą pozycję w państwie. Kraj znowu pogrążył się w chaosie, a w 1795 roku zniknął, na 123 lata, z politycznej mapy Europy. Pamięć o Konstytucji 3 Maja jednak trwała. Dokument ten był dla Polaków dowodem, że potrafią zmieniać swojej państwo. Odwoływano się do jej przełomowego charakteru przez trwającą do 1989 roku (z przerwą na dwudziestolecie międzywojenne) walką o niepodległość.

Für die Polen ist die Verfassung vom 3. Mai eines der wichtigsten Dokumente in der Geschichte des Staates. Beschlossen am 3. Mai 1791, war sie nur 14 Monate gültig, dennoch ist der Jahrestag ihrer Verabschiedung ein Nationalfeiertag. Jetzt – im Rahmen des europäischen Jahres des Kulturerbes, dessen polnische Ausgabe durch das Internationale Kulturzentrum in Krakau koordiniert wird – befindet sich die Verfassung vom 3. Mai unter den vier polnischen Objekten, die mit dem Zeichen des europäischen Erbes honoriert werden. Diese Auszeichnung wird Objekten verliehen, die „einen starken europäischen Symbolwert haben und die gemeinsame Geschichte Europas und den Aufbau der Europäischen Union sowie die europäischen Werte und die Menschenrechte unterstreichen und damit ein Fundament des europäischen Integrationsprozesses darstellen“.
